1. Acceptance of Terms

By accessing the Pokeruptcy website, placing an order, participating in a livestream, purchasing products, utilizing the Vault service, or otherwise engaging with Pokeruptcy Retail LLC ("Pokeruptcy"), you agree to be bound by these Terms & Conditions and all related policies published on this website.

If you do not agree to these Terms, you should not use this website or purchase products from Pokeruptcy.

​

2. Products and Services

​

Pokeruptcy Retail LLC sells trading card game (TCG) products, collectibles, accessories, and related services, including but not limited to:

​

• Booster Packs

• Booster Boxes

• Elite Trainer Boxes

• Collection Boxes

• Single Cards

• Graded Cards

• Accessories

• Rip & Ship Services

• Vault Storage Services

All products are subject to availability. Inventory levels, product offerings, and pricing may change without notice.

​

3. Pre-Order Products

​

Certain products may be offered for sale before Pokeruptcy receives inventory ("Pre-Order Products").

​

Release dates, arrival dates, shipment dates, and livestream opening dates are estimates only and may change without notice.

Pre-Order Products may be delayed due to manufacturer allocations, distributor delays, shipping interruptions, inventory shortages, or other circumstances outside Pokeruptcy's control.

​

If Pokeruptcy is unable to fulfill a Pre-Order Product, the customer's sole remedy shall be a refund of the amount paid for the unavailable item.

​

4. Rip & Ship Purchases

​

Certain products may be purchased for live opening during a livestream ("Rip & Ship").

​

By purchasing a Rip & Ship product, the customer authorizes Pokeruptcy to open the product on their behalf during a livestream or recorded session.

​

Once a Rip & Ship product has been opened, the sale is final.

Customers acknowledge and agree that:

​

• Trading card contents are random.

• No specific card, rarity, value, grading outcome, or pull rate is guaranteed.

• Product opening constitutes fulfillment of the purchased service.

• Dissatisfaction with pack contents does not qualify for a refund, return, exchange, or chargeback.

5. Card Condition Disclaimer

​

Cards are pulled directly from manufacturer-sealed products.

​

Pokeruptcy does not guarantee:

​

• Gem Mint condition

• PSA 10, BGS 10, CGC 10, or similar grading outcomes

• Centering, print quality, or factory quality control

​

Factory defects, print lines, whitening, scratches, centering issues, surface defects, and other manufacturing imperfections are not grounds for refunds, returns, or exchanges.

​

6. Vault Service

​

Pokeruptcy may offer a Vault service allowing eligible purchases to be stored for future combined shipment.

Customers are responsible for requesting shipment of Vault contents within the storage period described in the Vault Policy.

​

Vault contents that remain unclaimed beyond the applicable storage period may be subject to storage fees, liquidation, donation, disposal, or return to inventory, where permitted by law.

​

No refunds will be issued for abandoned Vault contents.

​

7. Pricing and Availability

​

Prices may change at any time without notice.

​

Pokeruptcy reserves the right to:

​

• Correct pricing errors

• Modify product listings

• Limit quantities

• Refuse service

• Cancel orders

• Refund unavailable inventory

​

If an inventory or listing error occurs, Pokeruptcy may cancel the order and issue a refund.

​

8. Payment Authorization

​

By placing an order, the customer represents that they are authorized to use the selected payment method.

​

Pokeruptcy reserves the right to cancel, refuse, or investigate orders suspected of fraud, abuse, unauthorized activity, or violations of these Terms.

9. Shipping and Delivery

​

Shipping is governed by the Shipping & Vault Policy published on this website.

​

Estimated delivery dates are estimates only and are not guaranteed.

​

Pokeruptcy is not responsible for delays, interruptions, weather events, customs delays, or other shipping issues caused by carriers or circumstances beyond its reasonable control.

​

Customers selecting untracked shipping acknowledge that Pokeruptcy cannot guarantee delivery once the shipment has been accepted by the carrier.

​

10. Returns, Refunds, and Chargebacks

​

All sales are final except where required by law or expressly stated otherwise.

​

The following are not valid reasons for refunds, returns, disputes, or chargebacks:

​

• Unfavorable pack contents

• Failure to pull desired cards

• Disappointment with card values

• Grading outcomes

• Manufacturer quality control issues

• Opened Rip & Ship products

• Vault storage expiration

• Carrier delays

Customers agree to contact Pokeruptcy before initiating a payment dispute or chargeback.

​

Pokeruptcy reserves all legal remedies available in connection with fraudulent or abusive chargebacks.

​

11. Giveaways, Promotions, and Contests

​

Pokeruptcy may conduct giveaways, contests, promotions, or similar events.

​

Each promotion will be governed by its own rules, eligibility requirements, deadlines, and prize descriptions.

​

By participating, entrants agree to abide by the rules announced for the applicable promotion.

​

Void where prohibited by law.

​

12. Livestreams and Recorded Content

​

Rip & Ship purchases may be opened on publicly accessible livestreams and may remain available in recorded content after the livestream concludes.

​

By participating in a Rip & Ship stream, customers consent to the display of usernames, order information, and opened products during the stream.

​

Pokeruptcy will not intentionally display sensitive personal information such as shipping addresses, payment information, or private customer data.

​

13. Intellectual Property

​

All Pokeruptcy logos, branding, website content, graphics, images, videos, stream content, text, and designs created by Pokeruptcy remain the property of Pokeruptcy Retail LLC unless otherwise stated.

Pokémon®, Nintendo®, Game Freak®, The Pokémon Company®, Wizards of the Coast®, and all related trademarks remain the property of their respective owners.

​

Pokeruptcy is not affiliated with, sponsored by, endorsed by, or associated with any trademark owner unless expressly stated.

14. Limitation of Liability

To the fullest extent permitted by law, Pokeruptcy shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from:

• Product purchases

• Rip & Ship services

• Vault storage

• Shipping services

• Livestream participation

• Website use

​

Pokeruptcy's total liability for any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

​

15. Right to Refuse Service

​

Pokeruptcy reserves the right to refuse service, cancel orders, suspend accounts, remove customers from livestreams, or deny future purchases for any lawful reason.

​

16. Governing Law

​

These Terms & Conditions shall be governed by the laws of the State of Colorado without regard to conflict of law principles.

Any legal dispute arising from these Terms shall be brought in the appropriate courts located within Colorado.

17. Changes to These Terms

​

Pokeruptcy reserves the right to modify these Terms & Conditions at any time.

​

Changes become effective immediately upon posting to the website.

​

Continued use of the website, participation in livestreams, use of the Vault service, or purchases from Pokeruptcy constitute acceptance of the revised Terms.
