1. Acceptance of Terms

By accessing this website, placing an order, participating in a live stream, purchasing products, utilizing the Vault service, or otherwise engaging with Pokeruptcy Retail LLC, you agree to be bound by these Terms & Conditions and all related policies published on this website.

​

If you do not agree with these terms, you should not use this website or purchase products from Pokeruptcy Retail LLC.

2. Products and Services

​

Pokeruptcy Retail LLC sells trading card game (TCG) products, collectibles, accessories, and related merchandise.

Products may include, but are not limited to:

​

  • Booster packs

  • Booster boxes

  • Elite Trainer Boxes

  • Collection boxes

  • Graded cards

  • Single cards

  • Accessories

  • Rip-and-ship services

  • Vault storage services

​

Product availability is not guaranteed and may change without notice.

​

3. Rip & Ship Purchases

​

Certain products may be purchased for live opening during a livestream ("Rip & Ship").

​

By purchasing a Rip & Ship product, the customer expressly authorizes Pokeruptcy Retail LLC to open the product on the customer's behalf during a live stream or recorded session.

​

Once a product has been opened, the sale is considered final.

​

Customers acknowledge and agree that:

​

  • Trading card pack contents are random.

  • No specific card, rarity, value, grading outcome, or pull rate is guaranteed.

  • Product opening constitutes fulfillment of the purchased service.

  • Dissatisfaction with pack contents does not qualify for a refund, return, exchange, or chargeback.

4. Card Condition Disclaimer

​

Cards are pulled directly from manufacturer-sealed products.

​

Pokeruptcy Retail LLC does not guarantee:

​

  • Gem Mint condition

  • PSA 10, BGS 10, CGC 10, or other grading outcomes

  • Centering, print quality, or factory quality control

​

Factory defects, print lines, whitening, scratches, centering issues, surface defects, and other imperfections may occur and are not grounds for refunds or returns.

​

5. Vault Service

​

Pokeruptcy Retail LLC may offer a Vault service allowing customers to store eligible purchases for future combined shipment.

​

Customers are responsible for requesting shipment of Vault contents before the applicable storage period expires.

​

Vault contents remaining unclaimed beyond the stated storage period may be subject to storage fees, liquidation, donation, disposal, or return to inventory at the discretion of Pokeruptcy Retail LLC, subject to applicable law.

​

No refunds will be issued for abandoned Vault contents.

​

6. Pricing and Availability

​

Prices may change at any time without notice.

​

Pokeruptcy Retail LLC reserves the right to:

​

  • Correct pricing errors

  • Modify product listings

  • Limit quantities

  • Refuse service

  • Cancel orders

  • Issue refunds for unavailable inventory

​

In the event of an inventory error, the customer will receive a refund of the purchase price paid.

​

7. Payment Authorization

​

By placing an order, the customer represents that they are authorized to use the selected payment method.

​

Pokeruptcy Retail LLC reserves the right to cancel, refuse, or investigate orders suspected of fraud, abuse, unauthorized activity, or violations of these Terms & Conditions.

8. Shipping and Delivery

​

Shipping is governed by the Shipping & Vault Policy published on this website.

​

Delivery dates are estimates only and are not guaranteed.

​

Risk of loss transfers to the customer when an order is delivered to the shipping carrier.

​

Pokeruptcy Retail LLC is not responsible for carrier delays, delivery interruptions, weather events, lost untracked shipments, or other shipping-related issues beyond its reasonable control.

​

9. Returns, Refunds, and Chargebacks

​

All sales are final except where required by law or expressly stated otherwise.

​

The following are not valid reasons for refunds, returns, disputes, or chargebacks:

​

  • Unfavorable pack contents

  • Failure to pull desired cards

  • Disappointment with card values

  • Grading outcomes

  • Manufacturer quality control issues

  • Live-ripped products after opening

  • Vault storage expiration

  • Carrier delays

​

Customers agree to contact Pokeruptcy Retail LLC to resolve concerns before initiating payment disputes or chargebacks.

​

Fraudulent chargebacks may result in refusal of future service and collection efforts where permitted by law.

​

10. Giveaways, Promotions, and Contests

​

From time to time, Pokeruptcy Retail LLC may conduct giveaways, contests, promotions, or similar events.

​

Any such promotion will be governed by the specific rules, eligibility requirements, deadlines, and prize descriptions announced for that promotion.

​

By participating, entrants agree to abide by the rules announced for the applicable promotion and the decisions of Pokeruptcy Retail LLC regarding administration of the promotion.

​

Void where prohibited by law.

​

11. Livestreams and Recorded Content

​

Customers acknowledge that Rip & Ship purchases may be opened live on publicly accessible livestreams and may remain available in recorded content after the live broadcast concludes.

​

By participating in a Rip & Ship stream, customers consent to the display of usernames, order information, and opened products during the stream.

​

12. Intellectual Property

​

All website content, logos, graphics, branding, stream content, images, videos, text, and designs created by Pokeruptcy Retail LLC remain the property of Pokeruptcy Retail LLC unless otherwise stated.

​

Pokémon®, Nintendo®, Game Freak®, The Pokémon Company®, and all related trademarks are the property of their respective owners.

​

Pokeruptcy Retail LLC is not affiliated with, sponsored by, endorsed by, or associated with The Pokémon Company, Nintendo, Game Freak, Wizards of the Coast, or any other intellectual property owner unless expressly stated.

13. Limitation of Liability

​

To the fullest extent permitted by law, Pokeruptcy Retail LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from:

​

  • Product purchases

  • Rip & Ship services

  • Vault storage

  • Shipping services

  • Livestream participation

  • Website use

​

Pokeruptcy Retail LLC's total liability for any claim shall not exceed the amount paid by the customer for the specific product or service giving rise to the claim.

​

14. Right to Refuse Service

​

Pokeruptcy Retail LLC reserves the right to refuse service, cancel orders, suspend accounts, remove customers from livestreams, or deny future purchases for any lawful reason.

15. Governing Law

​

These Terms & Conditions shall be governed by and interpreted under the laws of the State of Colorado, without regard to conflict of law principles.

​

Any legal dispute arising from these Terms shall be brought in the appropriate courts located within Colorado.

​

16. Changes to Terms

​

Pokeruptcy Retail LLC reserves the right to modify these Terms & Conditions at any time.

​

Changes become effective immediately upon posting to the website.

​

Continued use of the website, participation in livestreams, use of the Vault, or purchases from Pokeruptcy Retail LLC constitutes acceptance of the revised Terms & Conditions.
